Its listed as out of stock now but jeez i thought $350 used was a steal, but i now know better.

My order went through. Even with import costs it is still less than one third the price on Audiophonics - pretty much the only place you can find it in the EU.

Honestly I’m probably going to keep it in the box and gift it to someone to start them on their audio journey.

So claiming that it was wrongly priced. In the EU this is illegal as payment is acceptance of offer and forms a binding contract. Chances of enforcing that is meh though.

But chances are at least slightly higher they let the order through if you complain about that and say you are going to file a complaint. From what I know stuff like that in the EU is at least taken more seriously in the US

Although would they just tell you your order was invalid anyways because you should have used the eu store or something?

They are prepared to ship here so they should obey the rules here. It may be worth a go if I can find the specific consumer protection rule to quote.

Edit:

They have a loophole to use:
" If you have a contract , the company can’t usually cancel your order, even if they realise they’ve sold you something at the wrong price. They’ll only be able to cancel it if it was a genuine and honest mistake on their part that you should’ve noticed."

They will say it should be obvious this was a silly price to sell it at and so no binding contract was formed. The rules seem to get slippery with online purchasing.

It’s law that sometime goes back to the Napoleonic code and earlier. In practice it is less contradictory than it appears. Essentially the question is “was it obviously too good to be true?” which I think we all thought was the case with this offer. Should they have honoured the sales? Personally I think yes, but they have the right not to if it was a real mistake which it seems it was.

Ah well. I never expected to be able to afford one anyway so a couple of days of being all “wtf?? I’m going to get one??” was still worth it :slightly_smiling_face:

if enough of us voice reasonable complaints (not just venting, but genuine customer service / legality complaints) maybe something will happen. it’s worth saying something.

You can only believe it when it has actually been sent.
Then you can no longer undo anything.

I don’t think there is anyone who would sue for it.
The costs would be too high.
And in the end, the plaintiff/defendant would have to come to America anyway.
So the airfare alone would be enough to afford a much nicer amplifier.
Apart from that, the plaintiff needs a US lawyer.

So yes, they will come out and say it was a mistake which is probably provable.
In the end it was a belated Christmas grinch.

Seriously I would have paid 400$ dallar if it was on offer that we don’t have the good one in Europe.
The customs clearance would also still be bearable that you end up paying $480-490 for everything.
That would be much cheaper than the offer from Audiophonics, which roughly wants 1150$ per unit.
Even that money would be too good for me and I could buy something else with it.
At 400$ I would think about it even though I really don’t need it.
I have two great tube based amps, what more could you want except maybe it’s just the hype train passing you by.

I would have begrudged anyone who was/is financially weakened by Corona or those who always wanted a good amp.
Also those who have saved hard for it or had to work hard for their money to be able to afford something like this.
As well as fathers who have this hobby but have always renounced it because of the wife and children.
Anything else would be a bit matrialistic or perhaps greedy to pay good money for little.
Without wanting to crucify myself.
Most of us are doing well if you consider the last 2 years and are healthy, what more could you want?
Many would like a lot and can’t.

Yeah, I don’t think a lawsuit would make sense or solve anything. But I do think most companies know their reputation and loyal customers are among the most valuable things they have. I think professionally challenging them on this decision, and questioning their commitment to their reputation within the audiophile community. It’s a long shot for sure, they can certainly walk away and likely have no consequences. But if they develop the reptuation for BS pricing that they then walk away from, it will become a black eye.

I laughed it off since we clearly were being predatory. It was a mistake but hell, they made the mistake not the the customer.

At least I’d already decided to give it away to someone and not put it out for sale at twice the price I paid for it. They still did corporate double talk in their cancellation notification as 1) an apology would have gone a long way and 2) an admission that it is a business decision NOT to fulfill the order, they way they phrased it, it’s because of a mistake in pricing that is keeping them from fulfilling the order.
